Agreement to Terms

By accessing and using earthcleanse Spanish language courses, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use our services.

Course Enrollment

When you enroll in our Spanish courses, you agree to use the course materials for personal, non-commercial purposes only. Course access is granted to the enrolled student and is not transferable to other individuals.

Intellectual Property

All course materials, including videos, texts, exercises, and other content provided by earthcleanse, are protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our course materials without explicit written permission.

User Conduct

You agree to use our Spanish courses in a lawful manner and not to engage in any activity that disrupts or interferes with the learning experience of other students. Prohibited activities include sharing course access credentials, attempting to hack or breach security measures, or using automated systems to access course content.

Acceptable Use

When using our Spanish language courses, you agree to:

• Use the courses for personal, non-commercial educational purposes only
• Maintain the confidentiality of your account credentials
• Respect intellectual property rights and not reproduce or distribute course materials
• Not engage in any activity that could harm, disable, or impair our platform or services
• Not attempt to gain unauthorized access to any part of our platform or other users' accounts
• Not use automated systems, bots, or scripts to access or interact with our platform
• Not transmit any viruses, malware, or harmful code
• Comply with all applicable Australian laws and regulations

Violation of these acceptable use guidelines may result in immediate termination of your account and access to our services, and may subject you to legal action.

Payment and Refunds

Course fees must be paid in full before access is granted. All payments are processed securely through our payment partners. Refund policies are outlined in our Return Policy.

Course Access

Upon enrollment, you receive lifetime access to the purchased course materials. However, we reserve the right to modify or discontinue courses with reasonable notice. We are not responsible for any loss of access due to technical issues beyond our control.

Limitation of Liability

Earthcleanse provides Spanish language courses for educational purposes. We do not guarantee specific learning outcomes or proficiency levels. To the maximum extent permitted by Australian law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of our courses.

Nothing in these Terms of Use excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Under the ACL, you are entitled to certain consumer guarantees, including that services will be provided with due care and skill, and that services will be fit for their intended purpose. If we fail to meet any consumer guarantee, you may be entitled to remedies including refund, replacement, or compensation for damages. Our liability for failure to comply with a consumer guarantee is limited to, at our option, supplying the services again or paying the cost of having the services supplied again.

To the extent permitted by law, our total liability for any claims arising from or in connection with these Terms of Use or our services will not exceed the amount you paid for the specific course giving rise to the claim.

Dispute Resolution

If you have a dispute with us regarding these Terms of Use or our services, we encourage you to contact us first to resolve the matter directly. If we cannot resolve the dispute through direct communication, you may:

• Contact the Australian Competition and Consumer Commission (ACCC) for consumer protection matters
• Seek assistance from your local consumer protection agency
• Pursue alternative dispute resolution methods such as mediation
• Commence legal proceedings in the appropriate Australian courts

Both parties agree to act in good faith to resolve disputes amicably before pursuing formal legal action.

Applicable Law

These Terms of Use are governed by and construed in accordance with the laws of South Australia, Australia. Any disputes arising from or in connection with these terms or our services will be subject to the exclusive jurisdiction of the courts of South Australia and the Federal Court of Australia, as applicable.

These Terms of Use are designed to comply with Australian law, including the Australian Consumer Law, the Privacy Act 1988 (Cth), and other applicable Commonwealth and state legislation.

Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We will make reasonable efforts to notify you of material changes to these terms.
